The User requesting a benefit for purposes other than his or her professional activity has the right to withdraw from the purchase agreement concluded with FOODALY or with the Partner without any penalty and without giving any reason within 14 working days under the terms and for the effects art. 52 paragraph 1 of the Consumer Code that apply from the day of receipt of the product purchased on FOODALY.

The withdrawal may be exercised by the Customer, pursuant to art. 54 paragraph 1 Consumption Code, using the withdrawal form in Annex I, Part B of the Consumption Code or by submitting any other explicit statement of its decision to terminate the contract, to be sent either by letter a/r to GUSTO LUCANO of Cloroformio Daniele via Sinni, 1 85020 – Lagopesole (PZ) or by email to serviceclienti@foodaly.it or by fax to +39 0971 1830140. The letter a/r e-mail or fax must contain product and order number. The burden of proving the correct exercise of the right of withdrawal, in accordance with the above procedure, is borne by the User.

Following the proper exercise of the withdrawal, unless FOODALY or the Partner withdraws the Goods directly, the User shall be liable to return the Goods without undue delay and in any case within 14 days from the date on which the User has communicated to FOODALY or the Partner its decision to withdraw from the contract pursuant to art. 54, c. 4. The User shall, on the packaging, display in a visible manner the document received by FOODALY as a result of the notice of withdrawal mentioned above, in which the shipping address and details of the order are already indicated to identify made to the destination. It is advisable for the user to include a copy of that document also in the package, in order to avoid the loss or the inability to identify the return once it has arrived in the warehouse. The costs of shipping the goods will be borne by the User, except where FOODALY did not notify the same in this regard at the conclusion of the contract, in accordance with Art. 57 paragraph 1 of the Consumption Code.

FOODALY or the Partner reserves the right to verify that the good, of which the User is solely responsible under art. 57 paragraph 2 Consumption Code, is in the same state as it was delivered or that the product has not been altered in its essential and qualitative characteristics and, as far as possible, preserves its original packaging and label. In the event that this is not available, the User will be required to return the product properly packaged in order to preserve its integrity. FOODALY may refuse to accept a withdrawal for foodstuffs that have been partially consumed. According to art. 59 of the recalled Consummation Code are excluded from the possibility of withdrawal of customized or customized goods or which, by their nature, can not be returned or subject to rapid alteration or deterioration.

Exceptions to the Right of Withdrawal

In any case, it is understood that, with respect to service provision, the right of withdrawal may not be exercised by the User after the full supply of the products by FOODALY if the supply has begun with the express agreement of the User and he has agreed to lose the right of withdrawal as a result of the full performance of the service by FOODALY. In any case, pursuant to art. 59 of the Consumption Code are excluded from the possibility of withdrawal of customized or customized goods or which, by their nature, can not be returned or are subject to rapid alteration or deterioration.


Any payment by FOODALY, if any, will be made in accordance with Article 56, paragraph 1 Consumption Code, as soon as possible, and in any case no later than 14 days from the date on which the FOODALY, the event giving rise to the reimbursement occurred and in the event of withdrawal from the day on which the User became aware of the exercise in question.

FOODALY will make a refund using the same means of payment used by the User for the initial transaction, unless expressly agreed with the User and provided that he or she does not have to bear any cost as a result of the use of the different means of payment. FOODALY will not be required to reimburse the delivery costs if the User has expressly chosen a different and more expensive delivery than that offered by FOODALY. It is understood that, except in cases where FOODALY has decided to collect the goods directly, FOODALY may withhold the refund until it has received the goods or until the User has demonstrated that he has returned the goods, of what situation to come first.

It should be noted that in the case of premium transactions (the so-called promotions), where the purchase of an asset is combined with another good that is sold at an irrational price or even given, the right of withdrawal will legitimately be exercised with the restitution of both of the goods subject to the purchase, in view of the constraint on the availability of the good in promotion compared to the first.
